Earthjustice represented the Sierra Club. Sunflower Electric Power Corporation sued Gov. Sebelius asking for 'injunctive relief' related to the October 2007 air quality permit denial. In December 2008 the Hearing Officer upheld the rejection of the plant (and permits). On July 1st, 2009 the EPA notified the State of Kansas and Sunflower Electric that a new air permit would be required.
