The gates are open, but make no mistake: The Battle Creek Landfill is still closed.
"They're doing some maintenance work and some other measures but at this point the Battle Creek Landfill is not accepting any solid waste," says Page County Administrator Buddy Burge.
Many believed that when a judge stopped the landfill's shutdown, trash would once again be flowing in and out of here. Eventually that may happen, but not yet.
"We need to wait and see what the latest decision from the court is," says Burge.
Even before last week's ruling, the county voted to appeal the DEQ shutdown, but mainly to use the landfill as a place for county trash, not widespread commercial use.
"The county is kind of on the sidelines at this point," says Burge.
So what happens next? NWS has until Monday to draw up an agreement for re-opening the landfill. If that doesn't happen, it'll be up to the court to decide whether this landfill will ever accept trash again.
If the landfill does not reopen Monday, the court will still consider the appeal by the Page County Board of Supervisors.
